David M. McCarthy
Chief Instructor

David M. McCarthy is an instructor at the Marine Corps Police Academy in San Diego, where he teaches legal courses (Constitutional Law, Criminal Law, Search and Seizure, Evidence, Courtroom Testimony, Authority and Jurisdiction, Law Enforcement Ethics and Federal Justice) as well as firearms, defensive tactics, first aid and other classes. He is a United States Marine Corps Rifle and Pistol Expert; a Life Member of the International Association of Chiefs of Police; a member of the Police Executive Research Forum; and a member of the Public Agency Training Council. Experienced in the private security field, David possesses a B.S.I.S. basic guard card and an exposed firearms card, and is LEOSA credentialed for C.C.W. carry.

David is certified in these additional areas: NRA certified Rifle, Pistol and Shotgun Instructor; NRA certified Law Enforcement Pistol and Shotgun Instructor; Range Safety Officer; National Safety Council First Aid and CPR Instructor; Drug Recognition Expert, Basic and Advanced Drugged Driver Detection; Force-on-Force Simulation Safety Instructor; Basic and Advanced Active-Shooter, Incident Commander; Baton, Taser and O.C. Instructor; Standardized Field Sobriety Test Instructor and SFST Train-the-Trainer.
With a J.D. from Fordham University School of Law and a member of the California State Bar, David is a practicing attorney. Between 1995 and 2010, he served as Deputy City Attorney/Prosecutor for the City of Culver City, California. Prior to this experience, David worked for a large law firm in Los Angeles, specializing in municipal law and representing municipal corporations and police departments. David is also a member of the New York State Bar, which he successfully joined following his graduation from law school. During his early legal career in New York City, he practiced public finance law on Wall Street.

David remained active in the Marine Corps Reserve while practicing law. He was recalled to active-duty for both Operation Desert Shield and Operation Desert Storm. In the Marine Corps Reserve, David served at the Joint Security Directorate of U.S. Central Command, where he supervised anti-terrorism task forces; drafted and implemented anti-terrorism/force protection strategic plans; planned and conducted force protection vulnerability assessments; supervised dignitary protection elements; managed civilian arming authorization programs; analyzed, prioritized and recommended funding priorities; and supervised the fielding of surveillance and scanning technologies. David was integral in the evaluation and selection of private security companies for a $3.5 billion theater-wide security contract.

After the attacks of 9/11, David was transferred to Special Operations Command Central where he served as a Counter-Terrorism Officer, specializing in high-value target acquisition, counter weapons of mass destruction proliferation, direct action, unconventional warfare and special reconnaissance. Altogether, he served five combat deployments in Iraq, Afghanistan and the Horn of Africa. David earned, among other medals, the Joint Service Meritorious Achievement Medal, the Joint Service Meritorious Commendation Medal and the Bronze Star Medal.
Before accepting his commission in the United States Marine Corps, David served for four years in the New York Police Department, earning citations for Exceptional Police Work and Outstanding Police Work. This experience enabled David to be assigned to the Military Police field after joining the Marines. In his pursuit of higher education, David has earned an M.A. in Criminal Justice from Long Island University (“Outstanding Graduate Student” Award), a B.A. in Criminal Justice and Political Science from C.W. Post College, and a B.S. in Security Operations and Management from the University of Phoenix. He is currently studying for a Bachelor of Science in Psychology.
